Frequently Asked Questions about THCa
Frequently Asked Questions (FAQ)
Is HTCa legal? HTCa (tetrahydrocannabinolic acid, commonly referred to as THCa) products are currently legal at the federal level under the 2018 Farm Bill when derived from hemp and containing less than 0.3% Delta-9 THC by dry weight. However, state and local laws vary widely—some states follow the federal standard, while others have additional restrictions or outright bans on certain hemp-derived products. We only ship to states and areas where HTCa is currently permitted. Regulations are subject to change, so it is your responsibility to verify the laws in your specific location. This is not legal advice—please consult local authorities or a legal professional if you have questions.
What is the current federal status of HTCa products as of April 2026? Federally, compliant HTCa products remain legal today. However, new legislation signed in late 2025 will implement a “total THC” standard (which includes THCa) effective November 12, 2026. After that date, many current HTCa products may no longer qualify as legal hemp under federal law. We recommend monitoring updates closely and stocking up if you wish to purchase before the change.
Is HTCa legal in my state? Legality depends on your specific state and local jurisdiction. In Nebraska, compliant hemp-derived HTCa products are currently legal under existing hemp regulations, but rules are tightening in many areas nationwide. During checkout we automatically restrict shipping to permitted locations only. If you’re unsure about your area, we encourage you to research your state’s hemp/cannabis laws or contact us before ordering. We ship to most states, However;
Please Note About Shipping
How does HTCa differ from Delta-9 THC? HTCa is the raw, non-psychoactive acidic form of THC found naturally in hemp. It only converts to Delta-9 THC when heated (a process called decarboxylation). Our products are lab-tested to meet current federal Delta-9 THC thresholds in their raw form and are sold strictly as hemp-derived consumables.
What shipping carrier do you use and how long does it take? All orders ship via UPS. Once processed and shipped, most domestic orders arrive in 2–5 business days, though exact delivery times can vary based on your location, carrier schedules, and any customs or holiday delays. You will receive a tracking number by email as soon as your package leaves our facility.
Do you ship to all states? No. We only ship to states and localities where HTCa products are currently legal under applicable federal, state, and local laws. Invalid shipping addresses are automatically flagged at checkout. If you have any questions about whether we can ship to your area, please reach out to our customer service team before placing your order.
What is your policy on lost, stolen, or damaged packages? We gladly refund or replace lost, stolen, or damaged shipments. Simply contact our support team with your order number and any relevant details (such as photos of damage or a police report for theft). We work directly with UPS to resolve these issues quickly and will make it right for you.
Can I return or exchange HTCa products? Because our products are consumables, we cannot accept returns or exchanges once the package has been opened or used (for hygiene, safety, and regulatory reasons). All sales are final except in cases of shipping issues covered above. Unopened packages may be considered for return within a short window—please contact us first before attempting any return.
Are your HTCa products lab-tested? Yes. Every batch comes with third-party Certificates of Analysis (COAs) verifying potency, purity, and compliance with current legal limits. You can request the COA for your specific order at any time.
What age requirement do I need to meet to purchase? You must be 21 years of age or older to purchase HTCa products from us. Age verification is required at checkout.

**What is THCa and how does it relate to hemp?**
THCa (tetrahydrocannabinolic acid) is the non-intoxicating acidic precursor to Delta-9 THC found naturally in raw cannabis and hemp plants. In its raw form, THCa does not produce strong psychoactive effects. However, when heated (through smoking, vaping, or cooking), it undergoes decarboxylation and converts into Delta-9 THC. High-THCa hemp flower is popular because it can deliver potent effects while remaining compliant with certain federal hemp guidelines.
### **What is the 2018 Farm Bill and why does it matter for THCa hemp?**
The 2018 Farm Bill (Agriculture Improvement Act) removed hemp from the federal list of controlled substances. It legally defined **hemp** as any part of the Cannabis sativa L. plant — including derivatives, extracts, and cannabinoids — with no more than **0.3% Delta-9 THC** on a dry-weight basis. This distinction allowed the cultivation, processing, and interstate sale of hemp-derived products, including high-THCa flower that tests below the 0.3% Delta-9 THC limit (even if THCa levels are much higher). This created the legal foundation for the current THCa hemp market.
### **Is THCa hemp flower federally legal under the Farm Bill?**
As of April 2026, **yes** — THCa hemp flower remains federally legal under the 2018 Farm Bill framework as long as the finished product contains **less than 0.3% Delta-9 THC** by dry weight. THCa itself is not counted in the Delta-9 THC limit in the original definition, which enabled the sale of potent “exotic” or “premium” THCa flower nationwide. Always erify third-party lab tests showing Delta-9 THC compliance.
### **What is the difference between Delta-9 THC and total THC in hemp testing?**
- **Delta-9 THC** — The primary intoxicating cannabinoid measured under the original 2018 Farm Bill definition.
### **Can states ban or restrict THCa hemp even if it’s federally legal?**
Yes. While federal law sets the baseline, individual states have the authority to impose stricter rules. Some states already ban or heavily restrict THCa flower and other intoxicating hemp products, while others fully follow the current federal Delta-9 THC standard. Legality can vary significantly by state, so always check your local laws before purchasing or shipping. Currently it is legal in most* states. We do not currently ship hemp products to: Arkansas, Hawaii, Idaho, Louisiana, Minnesota, Nevada or Wisconsin due to bans.
### **How should I verify if a THCa hemp product is compliant?**
Look for up-to-date **third-party lab tests (Certificates of Analysis)** that clearly show:
- Delta-9 THC levels below 0.3% (current standard)
- Total THC information (for transparency)
- No banned contaminants (pesticides, heavy metals, molds)
Reputable vendors provide batch-specific lab results and clearly state compliance with the 2018 Farm Bill.
### **Is it safe and legal to ship THCa hemp across state lines right now?**
Under current federal law, compliant THCa hemp products can generally be shipped interstate. However, the receiving state’s laws still apply — some states prohibit receipt or possession of these products.
